By accessing or using Arkan ("the Service"), operated by Arkan Workspace Inc. ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
2. Description of Service
Arkan is a multi-tenant, cloud-based ERP and business management platform. The Service provides tools for project planning, task management, CRM, accounting, inventory, HR, job costing, sprint tracking, time tracking, team collaboration, document management, and related features.
3. Accounts and Workspaces
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and for all activities that occur under your account.
- Each workspace is isolated and data is not shared between workspaces.
- The workspace owner is responsible for managing members, roles, and permissions.
- You may not share your account credentials with others.
- You must notify us immediately of any unauthorized use of your account.
4. Subscription and Payment
Some features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page.
- Subscriptions are billed in advance on a monthly or annual basis.
- All fees are non-refundable except as required by law.
- We reserve the right to change subscription fees upon 30 days' notice.
- Failure to pay may result in suspension or termination of your account.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations.
- Infringe upon the intellectual property rights of others.
- Upload or transmit viruses, malware, or other harmful code.
- Attempt to gain unauthorized access to other accounts or systems.
- Use the Service for any illegal, fraudulent, or harmful purpose.

6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Arkan Workspace Inc. The Service is protected by copyright, trademark, and other laws.
You retain ownership of all data and content you upload to the Service. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
You may terminate your account at any time by contacting us. Upon termination, we will delete your data within 30 days, unless retention is required by law.
9. Limitation of Liability
To the maximum extent permitted by law, Arkan Workspace Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
10. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Arkan Workspace Inc. is incorporated, without regard to its conflict of law provisions.
